Product Classification in the Webshop
Prototypes and Display Objects
1. Regulatory background
SMFP Solutions, based in Austria, holds the following business licenses in the field of manufacturing and supplying physical products:
- Mechatronics
- Production of architectural models and models for consumer goods
Under the mechatronics license, we are permitted to manufacture and supply products and components in a mechatronic context. This may include additively manufactured parts (e.g., 3D-printed components) as part of a project or an overall technical service.
This must be distinguished from the isolated supply of exclusively 3D-printed plastic parts as serial functional parts intended for distribution or placing on the market to third parties. For that area, a further material-specific business license would be required, which we do not hold.
For this reason, it is necessary to clearly classify webshop products as either a prototype or a display object.
2. Purpose of classification
The mandatory selection between “Prototype” and “Display Object” serves the clear contractual and regulatory classification of the respective product.
This is not a marketing category, but a legally relevant definition of the contractual purpose.
The classification defines the contractually agreed status of the delivered product.
3. Definition – Prototype
A prototype is a development, testing, or demonstration item primarily intended for:
- evaluation and testing purposes
- internal development processes
- technical demonstration
- constructive verification
- objects for personal or internal use (B2B & B2C)
A prototype is not provided as a serially manufactured, certified functional part for general market distribution.
Use within the customer’s own company, within the customer’s own project context, or for private personal use remains unaffected.
The classification is particularly relevant where distribution or placing on the market to third parties is intended.
4. Definition – Display / demonstration object
A display or demonstration object is an item primarily intended for:
- visual representation
- presentation or exhibition purposes
- demonstrations
- illustrative applications
- decorative objects
It is not provided as a serially distributed functional part that has been tested in a material-specific manner.
5. No material-specific series qualification
Products offered in the webshop are not supplied as serially manufactured, material-specific certified plastic functional parts with quality assurance testing for general market circulation.
The classification ensures that delivery takes place within the scope of the existing business licenses and is not classified as an unrestricted market-ready serial product.
6. Binding selection during checkout
During the webshop order process, the customer must select either:
- “Prototype”
- “Display Object”
This selection is mandatory. It:
- is a prerequisite for completing the order,
- is documented in the ordering process,
- forms part of the contract concluded between the parties,
- and is shown in the transaction and/or invoice documentation.
The selected classification determines the contractual character of the delivered product.
7. Relationship to the Terms and Conditions
This product classification complements the Terms and Conditions of SMFP Solutions.
In connection with an order, the customer’s selection specifies the subject matter of the contract and its legal classification.
